DemoCatch

Terms of Sale and Use

Last updated: 13 octobre 2026

These Terms of Sale and Use (the “Terms”) govern access to and use of the DemoCatch service, operated by the sole trader identified in the legal notice (the “Provider”). DemoCatch is an online platform for creating interactive product demos, intended exclusively for professionals acting in the course of their business (companies, freelancers, public bodies). Any use of the service constitutes full acceptance of these Terms.

1. Purpose

These Terms define the conditions under which the Provider supplies the DemoCatch service (the “Service”) and the conditions of its use by the professional customer (the “Customer” or “User”).

They apply to the exclusion of any other document, in particular the Customer's general purchasing conditions.

2. Definitions

“Service”: the DemoCatch platform available online, its features and its own content.

“Account”: the space created by the User to access the Service.

“Customer Content”: all items (images, text, contact data, etc.) imported or created by the User through the Service.

“Subscription”: the paid plan taken out by the Customer, granting access to the corresponding features.

3. Acceptance

Creating an Account and/or taking out a Subscription implies unreserved acceptance of these Terms by an authorised representative of the Customer.

The Provider may amend them at any time under the conditions set out in the “Amendments” article.

4. Description of the Service

The Service lets users create, customise, publish and share interactive product demos, and analyse how they are viewed.

Available features depend on the plan taken out, as described on the Pricing page. The Provider may develop the features to improve the Service.

5. Access and Account

Access to the Service requires creating an Account. The User undertakes to provide accurate information and keep it up to date.

The User is solely responsible for the confidentiality of their credentials and for any activity carried out from their Account, and shall inform the Provider without delay of any unauthorised use.

A free offer may be made available for a first demo, with no commitment and no payment card, within the limits described on the Pricing page.

6. Plans, prices and payment

Subscription prices are shown in euros on the Pricing page. As the Provider falls under the French VAT exemption scheme, prices are net of tax (“VAT not applicable, Article 293 B of the French Tax Code”).

Payment is made by bank card through the secure payment provider Stripe. No bank card data is stored by the Provider.

Subscriptions are payable in advance according to the chosen frequency (monthly or yearly). Access to paid features is conditional on the payment actually being collected.

The Provider may change its prices; any change has no effect on the current period and applies to the next renewal, after informing the Customer.

7. Term, renewal and termination

The Subscription is taken out for the chosen term (monthly or yearly) and renews automatically for an identical term unless terminated.

The Customer may terminate at any time from their space. Termination takes effect at the end of the current period; access is maintained until then. Amounts already paid are not refunded on a pro rata basis, unless a mandatory legal provision states otherwise.

The Provider may suspend or terminate access in the event of a breach of these Terms, after formal notice has remained without effect within a reasonable period, except for a serious breach justifying immediate suspension.

8. Professional customers — no right of withdrawal

As the Service is intended exclusively for professionals acting for the purposes of their business, the provisions of the French Consumer Code relating to the right of withdrawal do not apply.

By subscribing, the Customer acknowledges that it is acting in a professional capacity.

9. User obligations

The User uses the Service in accordance with applicable law and these Terms, without misusing it.

The User warrants that it holds all rights necessary over the Customer Content it imports or distributes, and shall not publish any unlawful or misleading content or content infringing the rights of third parties or public order.

The User shall refrain from any action likely to disrupt the Service (intrusion, circumventing limits, large-scale automated extraction, etc.).

The User is responsible for the contacts it collects through its demos and for informing the individuals concerned (see “Personal data”).

10. Intellectual property

The Service, its brand, its software components, its interface and its own content remain the exclusive property of the Provider; these Terms do not transfer any such rights.

Customer Content remains the property of the Customer, who grants the Provider a non-exclusive licence limited to hosting, displaying and processing that content, solely to provide the Service and for the duration of the Subscription.

11. Availability and maintenance

The Provider uses reasonable means to ensure the availability of the Service, without guaranteeing uninterrupted or error-free operation. The Service is provided “as is”.

The Provider may temporarily interrupt the Service for maintenance or development, endeavouring to limit the impact.

12. Liability

The Provider's liability can only be incurred in the event of proven fault and only for direct and foreseeable damage; indirect damage (loss of turnover, data, customers or image) is in particular excluded.

To the extent permitted by law, the Provider's total liability under these Terms is capped at the amount paid by the Customer during the twelve (12) months preceding the triggering event.

The Provider is not responsible for the Customer Content or for the Customer's use of the Service.

13. Personal data

The processing of personal data is described in the Privacy Policy, which forms an integral part of these Terms.

For contacts collected by the Customer through its demos, the Customer acts as data controller and the Provider as data processor, within the meaning of the GDPR.

14. Force majeure

The Provider shall not be liable for non-performance due to an event of force majeure within the meaning of Article 1218 of the French Civil Code, or to an event beyond its control, in particular the failure of an infrastructure provider.

15. Amendments

The Provider may amend these Terms, in particular to reflect legal or Service developments. Customers are informed of substantial changes.

The applicable version is the one in force on the date the Service is used; continued use constitutes acceptance.

16. Governing law and disputes

These Terms are governed by French law.

In the event of a dispute, the parties will seek an amicable solution. Failing agreement, and as these are business-to-business relations, jurisdiction is granted to the courts of the Provider's registered office, unless a mandatory legal provision states otherwise.

These Terms are drawn up in French; translations into other languages are provided as a courtesy. In the event of any discrepancy, the French version prevails.
